SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 21 March 1995, DA, HQ, 102
nd United States Army Reserve Command, 4301 Goodfellow Boulevard, St. Louis, Missouri, Orders 047-011 discharged the applicant from the United States Army Reserve effective date 21 March 1995. That order indicates that the applicant was discharged under the provisions of Chapter 5, AR 135-178, by reason of entry level performance and conduct with service uncharacterized. The specific facts and circumstances leading to the applicant’s discharge are not contained in the available records.

         b. On 21 March 1995, the applicant was discharged. At the time of discharge, the applicant had completed 1 year, and 2 months of active military service. However, his record contains no evidence to show that he ever reported to, or completed Active Duty for Training (ADT).

Legal/Regulatory Basis for Separation Action : Army Regulation 135-178 Chapter 5 provides for the separation of members of the Army National Guard and Army Reserve when it is determined that a service member is unqualified for further military service by reason of unsatisfactory performance or conduct (or both) while in an entry level status. The service of a member separated under this provision of Army Regulation 135-178 will be characterized as uncharacterized as warranted by his or her military record.

         a. Propriety:    The applicant has not submitted an issue of propriety and the ADRB has not otherwise relied upon an issue of propriety to change the discharge.

         b. Equity:       The parenthetical number(s) below correspond(s) to the issue number(s) on the DD Form 293, or in Part VI, Paragraph 1, above.

(1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The applicant’s record is void of the specific facts and circumstances concerning the events that led to his discharge from the United States Army Reserve. However, the applicant’s record does contain a properly constituted separation order dated 21 March 1995. This order indicates that the applicant was discharged under the provisions of Chapter 5, AR 135-178, by reason of entry level performance and conduct with service uncharacterized. Army Regulation 135-178 provides, in pertinent part, for the separation of USAR enlisted soldiers because of unsatisfactory performance or conduct (or both) while in an entry-level status. For USAR soldiers entry-level status begins on enlistment and terminates, for soldiers ordered to active duty for training (ADT) for a continuous period, 180 days after beginning of ADT. The purpose of the entry-level status is to provide the soldier a probationary period. Soldiers who are found to lack the necessary motivation, adaptability, self-discipline, ability, or attitude to become productive soldiers may be expeditiously separated while in entry-level status. This is not an adverse separation action and denotes only that the individual had less than l80 days on active duty. A general discharge is not authorized under entry-level status conditions. A fully honorable discharge may be granted only in cases which are clearly warranted by unusual circumstances involving outstanding personal conduct and/or performance of duty. The Board determined that no such unusual circumstances were present in the applicant’s record and his service did not warrant an honorable discharge. Barring evidence to the contrary, the Board presumed administrative regularity in the discharge process. The Board acknowledges the applicant's successful transition to civilian life and noted the many accomplishments outlined in his application. However, the Board found that these accomplishments did not overcome the reason for discharge and characterization of service granted. Further, the Board does not grant relief solely for the purpose of gaining employment or enhancing employment opportunities. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief.
